THIS MEMORANDUM OF AGREEMENT
By and between the Board of Education of Murray City, as first party,
and Lottie L. Cottam as second party.
WITNESSETH: That the first party hereby employs the second party to teach school in Murray City, Utah for nine school months, beginning September 8, 1908 and agrees to pay therefor at the rate of seventy dollars per school month, of four weeks, of five days each, for the time actually occupied in school (legal holidays to be counted as school days): payment to be made within one week after the end of each school month, provided, that if the school to which the second party is assigned be closed for ten or more consecutive school days to prevent the spread of contagious disease, the second party shall receive half pay only for the whole of the time school is closed.
IN CONSIDERATION of said employment, it is agreed that the entire time and best efforts of said second party be given the schools of said city to which the second party has been assigned, upon the terms and at the price above named, in accordance with and subject to such rules and regulations as have been made or may be made by said board; and subject to the control, direction and guidance of the Superintendent of schools of said city. At any time upon request the second party agrees to furnish to the Board a certificate of a reputable practicing physician to be designated by the Board of Education, showing the state of health of the second party; if at any time the physical condition of the second party shall in the opinion of the Board be prejudicial or injurious to the welfare of the schools, this contract may be immediately terminated.
This contract may be terminated by the first party at any time for misconduct, insubordination, incompetence or persistent violation of the rules of the Board or instructions of the Superintendent, or for any other reason on four week’s notice, but unless so terminated shall continue in force until the close of schools in the school year beginning July 1, 1908.
IN WITNESS WHEREOF, said parties have duly executed this contract in duplicate this 22 day of May, 1908.
